These Terms govern your use of the websites and services operated by The Mavion Corporation. By using them, you agree to these Terms.

1. Acceptance

By accessing or using tmc.gg or any service operated by The Mavion Corporation (“TMC,” “we,” “us”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Services.

2. Our services

The Services include Mavion (our media network), TMCast internet-radio hosting, ASCAP licensing assistance, and related sites and tools. We may add, change or discontinue features at any time.

3. Accounts & eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Services. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity under your account.

4. TMCast hosting & plans

TMCast hosting is offered on monthly plans (e.g. Starter, Pro, Business). Plans are billed monthly in advance unless stated otherwise. You are solely responsible for the content you broadcast on your station and for complying with all applicable laws.

5. Acceptable use

You agree not to use the Services to:

• broadcast or distribute content you do not have the rights to;
• violate any law or third-party right;
• transmit malware, spam, or attempt to disrupt or gain unauthorized access to our systems;
• harass, threaten, or harm others.

We may remove content or suspend stations that violate these Terms.

6. Content & intellectual property

You retain ownership of the content you upload or broadcast. You grant us a limited licence to host, store, and transmit that content as needed to operate the Services. The names, logos and marks of The Mavion Corporation — including Mavion, TMCast and the TMC mark — are our property and may not be used without permission.

7. Payment, renewal & cancellation

Paid plans renew automatically each billing period until cancelled. You may cancel at any time, effective at the end of the current period. Except where required by law, fees already paid are non-refundable. We may change pricing with advance notice.

8. Termination

We may suspend or terminate your access if you breach these Terms or use the Services in a way that harms us, other users, or third parties. You may stop using the Services at any time.

9. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, The Mavion Corporation will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profits, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless The Mavion Corporation from any claims arising out of your content, your use of the Services, or your breach of these Terms — including, without limitation, claims relating to music licensing.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in California.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new “last updated” date. Continued use of the Services after a change means you accept the updated Terms.
